By accessing or using bitHuman's services, including our API, SDK, website, and related products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
bitHuman provides an AI-powered platform for creating and deploying interactive digital avatars and agents. Our Services include:
To access certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
Some Services require payment of fees. You agree to pay all applicable fees as described on our pricing page. Subscriptions automatically renew unless cancelled before the renewal date. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
Your Content: You retain ownership of any content you create using our Services. By using the Services, you grant bitHuman a limited license to process your content solely to provide the Services.
Our Technology: bitHuman retains all rights in our technology, including our AI models, software, APIs, and documentation. You may not copy, modify, distribute, or create derivative works from our technology except as expressly permitted.
Use of our API and SDK is subject to rate limits and usage quotas associated with your subscription plan. You agree not to circumvent these limits or use the API in ways that could damage, disable, or impair our Services.
Creators who publish applications through our Creator Hub may participate in our revenue sharing program. Revenue shares are calculated and paid according to our Creator Program terms. bitHuman reserves the right to modify revenue sharing percentages with notice.

Either party may terminate this agreement at any time. bitHuman may suspend or terminate your access to the Services if you violate these Terms. Upon termination, your right to use the Services will cease immediately.
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. BITHUMAN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITHUMAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
We may modify these Terms at any time. We will provide notice of material changes through our Services or by email. Your continued use of the Services after such notice constitutes acceptance of the modified Terms.
